When a right of withdrawal arises

A right of withdrawal may be available to consumers who enter into a contract without meeting in person, for example through a site such as this one or by email. What applies in detail is governed by sections 312c, 312g and 355 of the Bürgerliches Gesetzbuch (BGB, the German Civil Code).

The same applies if you conclude the contract away from our business premises, for example during a visit to you or at a trade fair (section 312b of the Bürgerliches Gesetzbuch).

A consumer is any natural person who enters into the contract for purposes that are predominantly neither commercial nor those of a self-employed profession.

At present you cannot order through this site

This site does not accept orders. The products are listed on request, without a price. There is no cart and no checkout. The “Add to cart” button is switched off.

For that reason this page carries no instructions stating a withdrawal period and no model withdrawal form. What the home page says about withdrawal under “Where you stand legally” takes effect as soon as you are able to order from us.

When you do have a right of withdrawal

If you write to us through the request form and we then send you a quote, the contract may be concluded later by email or over the telephone. A contract of that kind can be a distance contract. If you enter into it as a consumer, you then have a right of withdrawal.

The law exempts a number of cases, for example goods made specifically to your specifications (section 312g paragraph 2 of the Bürgerliches Gesetzbuch). Where this applies to a product, it is stated with the product before you order.

In such a case, please ask for the withdrawal instructions before the contract is concluded.

Purchases for a business

Anyone buying for their trade or for a self-employed professional activity is not a consumer. What matters is the purpose for which the purchase is predominantly intended. There is no statutory right of withdrawal between businesses.

If we agree in an individual case to take goods back from a trade customer, that applies because we have agreed to it, and not because the law obliges us to.

What will stand here once you can order from us

The full instructions will then appear at this point. They will contain:

• the conditions, the period and the procedure for withdrawal
• the model withdrawal form as a download
• the address and the ways in which you can declare your withdrawal
• what happens to the goods and to your payment after a withdrawal

Any period we stated today would not apply to any purchase.
